Terms of Service

1. Scope and Provider

These Terms of Service ("Terms") govern your use of the PEXim platform ("Service"), operated by marbl.energy ("we", "us"), registered in Austria. By creating an account or using the Service, you agree to these Terms.

2. Description of Service

PEXim is a simulated multimarket exchange environment for European power markets. The Service provides:

  • Simulated intraday continuous, day-ahead auction, and aFRR activation trading
  • REST and gRPC APIs for algorithmic trading agent development
  • Performance benchmarking and shadow evaluation tools

PEXim is a simulation platform. No real electricity, financial instruments, or regulated commodities are traded. No real money is at risk through trading activity on the platform.

3. Account Registration

To access the Service you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials. You must be at least 18 years old or have legal capacity to enter into contracts under applicable law.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to disrupt, overload, or interfere with the Service infrastructure
  • Reverse-engineer, decompile, or extract source code from the Service
  • Share API keys or account credentials with third parties
  • Misrepresent simulated results as real market data or trading performance

5. Pricing and Payment

The Free tier is available at no cost within stated usage limits. Paid plans (Pro) are billed monthly or annually as selected. Prices are in EUR and include applicable VAT for Austrian and EU customers. We reserve the right to adjust pricing with 30 days notice.

6. Data and Intellectual Property

You retain ownership of your trading algorithms and agent configurations. We retain ownership of the platform, simulated market data, matching engine, and all related intellectual property. Aggregated, anonymised usage data may be used to improve the Service.

7. Availability and Liability

We aim for high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranties of any kind. Our liability is limited to the fees paid by you in the 12 months preceding the claim, except in cases of intent or gross negligence. This does not affect mandatory consumer protection rights under Austrian law.

8. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms with reasonable notice. Upon termination, your data will be deleted in accordance with our Privacy Policy.

9. Changes to Terms

We may update these Terms with 30 days notice via email. Continued use after the notice period constitutes acceptance. If you disagree, you may terminate your account.

10. Governing Law and Jurisdiction

These Terms are governed by Austrian law. The courts of Vienna, Austria have exclusive jurisdiction. For consumers within the EU, mandatory consumer protection provisions of your country of residence apply.
